Brasília – The 1st Panel of the Superior Court of Justice (STJ) made a decision on Wednesday (14/8). The decision states that the National Health Surveillance Agency (Anvisa) cannot go beyond the legislation in this area. It cannot create additional requirements regarding the advertising of drugs.

The panel unanimously supported the position of the rapporteur, Minister Regina Helena Costa. Anvisa should limit its regulatory power to the faithful execution of Law 9,294/1996. This law regulates restrictions on drug advertising.

“The regulatory agency lacks the normative power to, by its own act, restrict or limit the actions of economic agents in terms of commercial advertising of pharmaceuticals, especially when its regulatory acts violate the rules of Law 9,294,” stated Costa.
