Brasília – The Senate’s Economic Affairs Committee (CAE) passed on Tuesday (2) a bill (PL 4.719/2020) that exempts donated medicines from federal taxes. The proposal mandates that donations must have at least six months of remaining shelf life and be directed to the Union, states, federal district, municipalities, Santa Casas, the Brazilian Red Cross, or certified charitable entities.
The exemptions cover PIS/Pasep, Cofins, and the Industrialized Products Tax (IPI), and recipients must distribute the medicines on a non-profit basis — resale is prohibited. Senator Fernando Farias (MDB-AL), the bill’s rapporteur, highlighted that approximately 14,000 tons of medications are discarded annually in Brazil, posing environmental risks; the measure aims to mitigate this waste and aid vulnerable populations. Two amendments from Senator Mara Gabrilli (PSD-SP) were incorporated: one mandates regulation of inspection procedures, and another expands eligible beneficiaries to include OSCs, OSCIPs, and social organizations. The bill now moves to the Senate Plenary.
