Brasília – During a public hearing in the Chamber of Deputies, advocates for neurodivergent individuals called on the Superior Court of Justice (STJ) to uphold existing laws that guarantee multidisciplinary care for people with disabilities. On November 6, the Court will rule on whether health insurers can limit therapy coverage for neurodivergent patients — a decision that will have binding effect nationwide.

Representatives from the Brazilian Institute for the Defense of Autistic Rights (IBDTEA) cited a broad legal framework protecting this population, including the Brazilian Inclusion Law, the Berenice Piana Law and the Consumer Protection Code. They stressed that any restriction by health plans would violate fundamental constitutional principles such as the right to health and human dignity.

Health-insurance associations, meanwhile, argued for the creation of national clinical guidelines to reduce litigation and standardize care. The Chamber’s Commission on the Rights of Persons with Disabilities emphasized that regulatory and judicial processes must not be used to delay access to essential therapies, underscoring the urgency of integrating scientific evidence with effective, equitable care.
