Brasília – A decision by the Federal Court has authorized the compounding pharmacy network Biomagistral to produce and dispense cannabidiol (CBD)-based medicines, marking a potential turning point in Brazil’s regulatory landscape for medicinal cannabis.

The ruling allows compounding pharmacies to manufacture CBD formulations, provided they comply with prescription, safety, and technical requirements — an interpretation that challenges Anvisa’s RDC 327/2019, which currently restricts the production and sale of cannabis-derived medicines to industrialized products.

According to attorney Marco Feitosa, the decision reinforces “the right to equal access to effective treatments” and signals a possible regulatory shift. Biomagistral, which operates more than 270 pharmacies nationwide, had previously won similar cases at the state level.

The ruling could pave the way for other compounding pharmacies to seek the same authorization, potentially expanding access and reducing costs for patients who currently depend on imported or high-priced industrialized cannabis-based products.
