Brasília – The Superior Court of Justice (STJ) granted an additional 145 days for the Brazilian Health Regulatory Agency (Anvisa) and the federal government to finalize regulations on the cultivation of cannabis for medicinal and pharmacological purposes. The extension follows the 2024 decision under Incident of Assumption of Competence 16 (IAC 16), which mandated that the federal government establish the regulatory framework.

Anvisa has already begun drafting the rule, conducting technical studies and consultations with civil society. The extension aims to ensure a comprehensive and effective regulation that addresses safety, oversight, and patient access.

According to the Ministry of Health, more than 670,000 Brazilians currently use cannabis-derived medicines, mostly through court orders. Since 2022, the Ministry has fulfilled over 800 judicial determinations for the supply of these treatments.
