Brasília – The National Council of Justice (CNJ) released a new practical guide aimed at standardizing how judges and court staff evaluate lawsuits seeking the provision of medicines through the Unified Health System (SUS). The document consolidates key guidance from Supreme Court precedents, including Theme 6 and Theme 1234, and outlines criteria such as verifying Anvisa registration, assessing available therapeutic alternatives, and defining financial responsibility among federal, state and municipal authorities.

The CNJ stresses that decisions should incorporate multidisciplinary analysis — legal, medical, pharmaceutical and administrative — to reduce inconsistencies and improve coordination between the judiciary and health authorities. The guide is intended to support more transparent, predictable and evidence-based rulings in health-related litigation, an area that continues to grow nationwide.
