Brasília – The Supreme Federal Court suspends the action that questions Anvisa’s advertising rules for medicines and foods until February 2026. The case involves RDC 96/2008, on drug advertising, and RDC 24/2010, which regulates the promotion of foods high in sugar, fats, or sodium. The Court schedules a conciliation hearing for early February, halting procedural deadlines until then.
According to the information provided to the Court, Anvisa is considering conducting Regulatory Impact Analyses (RIAs) for both resolutions, which were issued before the RIA requirement became mandatory. The lawsuit, filed by the Brazilian Association of Radio and Television Broadcasters (Abert), argues that the rules impose restrictions that should be defined by federal law. The suspension allows the parties to present technical elements and evaluate potential adjustments during the conciliation phase.
