Brasília – The Ministry of Health published new regulations allowing projects linked to Brazil’s public health system (SUS) to raise private capital through incentivized debentures. The measure, formalized by Portaria GM/MS nº 8.913/2025, sets criteria for hospitals, laboratories, primary-care units and other SUS-related institutions to finance construction, expansion and modernization of infrastructure via the capital market.
The rules apply exclusively to projects involving capital expenditures, such as building works, equipment acquisition or structural upgrades. Depending on the type of project and its qualification within federal investment programs, debenture issuance may fund up to 100%, 90% or 50% of the approved investment. Operational and maintenance expenses, however, are not eligible. After submitting documentation for validation by the Ministry’s Executive Secretariat, project sponsors may proceed with market issuance under standard regulatory requirements.
According to the Ministry, the initiative aims to expand the availability of private financing for public health infrastructure and accelerate the delivery of new or upgraded SUS facilities across the country.
